7.8.2.14                 HEARING PROCEDURES:

7.             Hearing procedures for an adverse action taken against a facility by the department will be conducted in accordance with Adjudicatory Hearings for Licensed Facilities, 7.1.2 NMAC.
8.             The facility will receive a copy of the hearing procedures at the time that an adverse action is taken or may request a copy by contacting the licensing authority.
9.             If immediate action is required to protect human health and safety, the licensing authority may suspend a license or impose an intermediate sanction pending a hearing, provided that the hearing is held within five (5) working days of the suspension or the sanction, unless waived by the facility, in accordance with the Public Health Act, Section 24-1-5 H NMSA
